These Terms of Service (“Terms”) are an agreement between you and AqiMeta concerning your access to and use of the AqiMeta website, Chrome extension, APIs, and related services (“Services”).
1. Acceptance
By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you use the Services for an organization, you represent that you have authority to bind that organization.
2. Eligibility and accounts
You must be legally capable of entering into a binding agreement and authorized to manage the business and advertising assets connected to the Services. Access is currently limited to approved users. You must provide accurate information and promptly update material changes.
3. Service scope
AqiMeta provides tools to inspect supported advertising structures, select target assets and creative files, calculate requested object counts, and submit controlled creation tasks. Supported Campaigns, Ad Sets, and Ads are configured to be created in PAUSED status. Paused status does not guarantee that a third-party platform will accept, approve, or retain any object.
AqiMeta does not provide investment, legal, tax, or advertising-performance advice. The Services do not guarantee impressions, conversions, return on ad spend, policy approval, or commercial results.
4. Your authorization
You authorize AqiMeta to access and process the accounts, assets, configuration, and creative materials you select, solely to provide the requested Services. You may revoke a connected account, although requests already sent to a third-party platform cannot always be withdrawn.
5. Your responsibilities
- Use only accounts and assets you are authorized to manage.
- Review targeting, budget, schedule, identity, destination, creative, and compliance settings before activation.
- Ensure all ads, destinations, products, and claims comply with applicable law and platform policies.
- Maintain sufficient account security, payment methods, permissions, and business verification.
- Do not use the Services to mislead, discriminate, evade review, infringe rights, or distribute unlawful content.
- Do not attempt to probe, disrupt, reverse engineer, or bypass access controls except where applicable law expressly permits.
6. Third-party platforms
The Services interoperate with independent third-party platforms. Their terms, policies, availability, permissions, review systems, APIs, and rate limits apply separately and may change without notice. AqiMeta is not responsible for a third party's suspension, rejection, policy decision, account restriction, data change, or service interruption.
7. Content and rights
You retain ownership of content and creative materials you submit. You grant AqiMeta a limited right to host, validate, transmit, transform where technically necessary, and otherwise process that content to provide and secure the Services.
AqiMeta and its licensors retain all rights in the Services, software, documentation, branding, and service-generated interfaces, excluding your content and third-party materials.
8. Security and access
You are responsible for safeguarding account credentials and authorized devices. Notify security@aqimeta.com promptly if you suspect unauthorized access. You must not share access tokens, application secrets, or test credentials through public channels.
9. Availability and changes
We may change, suspend, or discontinue features to maintain security, respond to platform changes, comply with law, or improve the Services. We aim to provide reasonable notice for material changes when practical, but urgent changes may take effect immediately.
10. Suspension and termination
You may stop using the Services and disconnect authorized accounts. We may restrict or terminate access for material breach, security risk, unlawful conduct, nonpayment where applicable, third-party platform requirements, or discontinued service availability.
11. Disclaimers
To the maximum extent permitted by law, the Services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation.
12. Limitation of liability
To the maximum extent permitted by law, AqiMeta will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, advertising spend, or business opportunities arising from the Services or third-party platforms.
13. Indemnity
To the extent permitted by law, you agree to defend and indemnify AqiMeta against claims, losses, and reasonable costs arising from your content, your advertising activity, your violation of these Terms, or your infringement of another party's rights.
14. General terms
If any provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent, except as permitted by law. We may assign them in connection with a reorganization, financing, merger, or sale of the Services.
Any service order, written agreement, or applicable local mandatory law may supplement these Terms. In the event of conflict, the specifically negotiated written agreement controls for its subject matter.
